How do I obtain your personal data?

I obtain the personal data listed above from you through my website, contact form, Typeform questionnaire, email, or from public registers, such as the Dutch Chamber of Commerce (KVK) or other publicly available sources.

03. Purposes

Why do I process personal data?

I only process your personal data when legally permitted to do so and for the purposes described below.

Requests and quotations

You are welcome to contact me without obligation to see whether we are a good match. In order to prepare a quotation, I need the contact details that I may later need to include on an invoice.

Even if you ultimately do not purchase my services, I retain the relevant data for up to 8 years after the last contact moment in order to substantiate my business activities to the Dutch Tax Administration. I also retain the data for my own quotation management and to analyse which quotations I have issued. Data that I am not legally required to retain for tax purposes will only be stored for 30 days.

Performance of an agreement

When I carry out an assignment for you, I will process your personal data. I process your name, address and email address in order to send you information, get acquainted, make appointments, carry out the assignment and ultimately deliver the final product.

This information is necessary for the performance of the agreement. Without this information, I cannot enter into the agreement.

Data that I do not need for invoicing, my portfolio, archiving or licensing purposes will be deleted once the assignment has been completed. I will also delete data when requested to do so, provided that I do not need the data for the performance of the agreement, my legitimate interests or my legal and administrative obligations.

Invoicing

If you commission me, I process the data necessary for the financial settlement of the assignment. This includes at least your name and email address, as well as any other information necessary to issue a correct invoice.

When a payment is made, I will also be able to see which bank account the payment came from and who the account holder is.

I retain invoices and payment information for 8 years in order to comply with my statutory retention obligations.

Licensing

When I create a film for you, we make agreements regarding the use of the final product. We do this through a licence.

In order to prepare the licence, I process your name and address details. I retain the quotation and the agreements made for at least the duration of the licence, in order to safeguard the agreements made and to be able to contact you regarding the licence if necessary.

Portrait photographs and video footage

During the execution of a videography assignment, portraits may be created in which you are recognisable. I also process these personal data for the performance of the agreement with my client. I will deliver the film to my client as the final product of the assignment.

I also have a legitimate interest in incorporating your portrait into my film, namely an artistic interest and an interest in using my artistic work for my own business activities, including promotion through my portfolio and social media.

In doing so, I have balanced your privacy interests against my own interests. In addition, in most cases the processing concerns information that you have made publicly available yourself.

My films are protected by intellectual property rights and copyright. I therefore retain these artistic works in my archive and portfolio.

I retain the raw footage recorded during the filming day for at least 1 year after recording, unless otherwise agreed.

Questions and other contact

If you send me a question or request information from me, I will contact you in response. I therefore process your name and email address so that I can provide you with an answer and/or the requested information.

I have a legitimate interest in doing so. Because I would like to be able to see who I have been in contact with for some time afterwards, I retain this information for up to 5 years after our last contact.

I share your data with the following third parties, including my data processors:

• Blogs and social media platforms, where applicable, for the promotion of my work

Transfers to third countries

I try to process personal data within the European Economic Area (EEA) as much as possible. However, in some cases I cannot avoid using services from outside the EEA.

These companies are located in countries that have been designated by the European Commission as providing an adequate level of data protection.

You have the right to object to the processing of your personal data.

If you object to the use of your personal data for direct marketing purposes, I will no longer use your personal data for this purpose.

Data portability

You have the right to receive your personal data from me in a structured, commonly used and machine-readable format so that you can transfer it to another party, where you have given me consent to process your data and the processing has been carried out by automated means.

If I obtained your data for a specific purpose based on your consent, you may withdraw this consent at any time. Withdrawing your consent does not affect the lawfulness of processing carried out before the withdrawal.
